Terms & Conditions

Reservations for short term holiday accommodation are accepted by Mistover Valley Holiday Properties office at 51 Amalfi Drive Hillarys  (Accommodation Manager) as the manager for the Owner of the Property and to which the following terms and conditions shall apply:


We do not provide accommodation for School Leavers during 'leavers' week, applications for other dates will only be accepted for guests over 21 years of age.

Please note that bookings for guests aged between 21 and 25 will be closely scrutinized and accepted at the Property Owner's discretion.


The Accommodation Contract is between the Guest and the Owner of the property for which the accommodation booking is made and is subject to the terms and conditions herein. The contract for accommodation shall not be effective until the Accommodation Manager sends the Guest written confirmation of the Booking. The Guest acknowledges that the Accommodation Manager acts as a Manager for the Owner only and not as a principal.


Tariffs are per night for the maximum amount of people the property can accommodate.

Minimum stays differ. Exceptions: - All Peak periods minimum 4 nights, Easter minimum 4 nights, all Long Weekends minimum 3 nights, all other times minimum 2 nights stay.

Service fees are compulsory as stated on the website, and must also be taken into account when booking.

A Service fee covers the initial preparation of the property, all bed linen, bathroom linen and the clean after you vacate. (We don't supply beach towels), the cleaning fee is compulsory. The suppling of linen is compulsory.

A Cleaning fee is for the clean after you vacate.


These documents detail all Terms and Conditions that are applicable when booking our Holiday Property.

The documents will be emailed directly to you, the Accommodation Booking Form and the Conditions of Short Term Holiday Rental are to be completed in full each page signed and returned to this office within THREE working days. Please note that your booking WILL NOT be confirmed until these documents are received.


The accommodation booking will not be confirmed by the Accommodation Manager until the Guest's deposit payment is received and cleared. A deposit of 50% of the accommodation charge is due within three (3) days to secure all bookings.

The deposit & final payment amounts can be paid using VISA*, MASTERCARD*, Cheque, Paypal, Money order or Direct Debit.


A deposit of 50% of the accommodation charge is due at the time of booking to secure all bookings using a valid credit card. Payment of this constitutes the guest acceptance of the booking terms and conditions.

The full amount payable in respect of the property rental is due a minimum of 30 days prior to arrival date for ALL bookings. This amount includes your security bond. *Credit Card Transactions - there is a surcharge applied when you choose to use a credit card to confirm and finalize your booking. Surcharge Rates (charged by the facility provider):1.00% surcharge on any VISA or MASTERCARD transactions


Check in shall be no earlier than 3pm and check out no later than 10am on day of departure


Mistover Valley is located in a quite rural setting and we request that voices / stereo's and foul language be kept to a minimum and stereo's will be turned off by 10pm on week nights and Sunday's and 12 midnight on Friday and Saturday nights. If the police are called or neighbours complain we will be evicted from the property with no refund of accommodation paid offered, Bond will also be forfeited. The owner or owner’s agent has the right to eject tenants from the property during their stay if it is deemed by the manager that the tenants are not looking after the property, respecting the neighbours or have too many people either at or residing at the property.


The property is to be left in a clean and tidy state, with floors swept, benches wiped, dishwasher emptied or dishes washed and put away. All rubbish must be emptied into the Sulo bins and put on the side of the road. Any excess rubbish that won't fit in the bin must be removed from the property or a rubbish removal fee will be charged to you. If the Sulo bins are not put out on the kerb when you vacate you will be charged for emptying them at the tip. Beds must be left with quilt covers straightened and clean. You must clean the BBQ if you have used it or you will be charged $60 from your bond. An amount deemed by the booking manager is payable by guest for any extra cleaning or rubbish removal and it shall be redeemable from the tenant where necessary. Any amounts required by booking manager from tenant shall be taken from the guests bond without prior notice to guest


Under no circumstances may the number of persons at the holiday home exceed the maximum number of persons as stated on the web site that the property sleeps. If this becomes apparent to the booking Manager, then the guests shall be immediately evicted and no refund granted.


Pets are not permitted at our property

Any booking where an unauthorised pet has been at the property will immediately result in the property being fumigated and sanitised and all soft furnishings dry cleaned. Any associated costs will be payable by the guest, and shall be taken from the guests bond without prior notice to the guest.


The Guest acknowledges that the bond shall be used for any extra cleaning, breakages or damage done to the property or its surrounds as deemed by the property manager and shall be deducted from the bond without prior consent to tenant. Any and all bond due to the tenant shall be refunded within 10 working days to the tenant.


The Booking Manager recommends that the Guest takes out comprehensive holiday cancellation and protection insurance with a reputable insurance company to cater for any unforeseen circumstances which may arise including accident, ill health or any other matters beyond the Guest's reasonable control, as once the booking has been made and confirmed, the Guest will be responsible for payment of the full rental whether or not occupation of the Property occurs.


All personal belongings, baggage, vehicles and other property of the Guest of any description shall be at the risk of the Guest at all times and neither the booking manager nor the Owner accepts any responsibility for any loss or damage thereto.


The Manager and the Owner reserve the right to revoke or refuse to honour any property accommodation booking which may in the opinion of either party (and at their sole discretion) be unsuitable for the Property concerned. The owner has the right to cancel a booking at any given stage issuing a full refund to the tenant for no apparent reason.


The guests shall be responsible for the Property during the Guest's stay. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition. The Guest shall be liable for any breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest's occupation of the Property and all costs of repairs and replacement thereof shall be payable to the Manager or the Owner upon demand. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the Manager or Owner as soon as practicable after the damage occurring thereto. An amount deemed by the booking manager is payable by the guest for any extra cleaning or rubbish removal shall be redeemable from the tenant where necessary. If any damage is done to gardens or outside of the property, the tenant shall also be held responsible and the costs redeemable from the tenant's bond.


The Guest acknowledges that the Manager has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and the Manager and the Manager shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.


All information in respect of the Property contained in the Manager's advertising is believed to be correct at the time of printing, however all details contained in the flyer are subject to change by the Manager and/or the Owner without notice. The Accommodation Manager will not accept any responsibility for any alterations to the Property or any part thereof beyond the Accommodation Managers control or any liability for any matter or occurrences beyond the Accommodation Managers reasonable control including damage caused by extreme weather conditions, break down of appliances, wiring, plumbing, invasion of pests, or noise disturbance attributed to nearby construction, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.


If additional features such as a swimming pool, outdoor spa or other facilities are shown in the brochure, on the website as being available at the property concerned, the Guest acknowledges that the use of any additional amenities is entirely at the Guest's risk and neither the Accommodation Manager nor the Owner shall accept any responsibility for any injury loss or damage to property or any third party arising from the use thereof.


Once your booking has been confirmed and receipted by the Manager your full deposit is only refundable up to 30 days prior to your check in date.

Should you wish to cancel your booking after the 30-day grace period, please be advised that a full refund less one (1) night’s stay shall be refunded within 24 hours. Please be advised a one off booking fee of $66 will apply if the property is not fully rebooked by another tenant for your cancelled dates.
